The U.S. Fish and Wildlife service designated the lizard an endangered species in May of 2024, after it found that oil and gas development in the Permian Basin made the loss of its habitat effectively permanent.

Texas Attorney General Ken Paxton then sued the Biden Administration for this decision, arguing it was politically motivated, and could harm property owners and energy production.
