MONTGOMERY COUNTY, Texas (KTRK) -- The family of 24-year-old Erika Serrato, the Montgomery County Sheriff's deputy who was killed while on duty, has filed a wrongful death lawsuit against the company of the truck that struck her back in June, according to the family's legal team.

On June 28, Deputy Serrato responded to a separate multi-vehicle crash in the northbound lanes of I-45 caused by a man, identified as Ashton Jammer, according to MCSO.

Jammer was arrested and charged with DWI, officials said.
