A federal judge ruled against Minnesota's effort to keep an Immigration and Customs Enforcement officer in custody while facing charges related to a fatal shooting that occurred earlier this year.

Christian Castro was apprehended by Texas Rangers in the South Texas region during May. The case centers on a shooting incident that drew Minnesota authorities' attention, prompting them to seek Castro's return to Minnesota for prosecution.

Minnesota prosecutors moved to block Castro's release by requesting a temporary restraining order, citing concerns that the suspect could flee the state. However, the federal judge determined the restraining order could not be issued because Texas Gov. Greg Abbott had not yet ruled on Minnesota's extradition request.

Under Texas law, individuals awaiting extradition proceedings face a 90-day holding limit. This legal constraint creates a time-sensitive situation for authorities seeking to transfer Castro across state lines.

In a court filing submitted Monday, Abbott's office contended that Castro had not absconded from Minnesota. Instead, the governor's motion stated that Castro had returned to Texas to pursue employment opportunities. This assertion contradicts the Minnesota officials' characterization of the situation as a flight risk.

The ruling leaves the extradition decision pending with Abbott, whose determination will ultimately shape Castro's legal proceedings. The judge's order suggests that without the governor's denial of the extradition request, the court lacked grounds to prevent Castro's potential release under state law parameters.
