Texas Gov. Greg Abbott orders halt to all data center permits

Governor Greg Abbott moved Monday to impose sweeping restrictions on data center development across Texas, directing state regulators to freeze all new permits for such facilities until federal grid operators complete a comprehensive examination of the industry's impact on the state's power supply and water resources.

The directive, issued to the Texas Commission on Environmental Quality, represents the latest escalation in Abbott's efforts to curb rapid expansion of data centers in a state already grappling with growing electricity demand. The measure requires the Electric Reliability Council of Texas to finish its audit of existing and planned data center operations before state agencies can approve any new projects seeking environmental permits.

State officials framed the action as essential to protecting Texans' immediate interests. "Simply put, Texans must come first," Abbott said in a statement. "Data centers must pay their own way, protect our grid and water, and complete the ERCOT and TWDB audits. Until they do, TCEQ will issue no permits sought by data center projects."

The freeze comes weeks after Abbott directed multiple state agencies to scrutinize data center operations. In mid-September, he instructed the Texas Water Development Board to enforce existing water-usage reporting laws against data centers, impose penalties for violations, and collaborate with ERCOT in gathering additional information about water consumption in the industry. Simultaneously, Abbott ordered the Public Utility Commission and ERCOT to examine all data centers currently seeking grid connections.

Any data center project hoping to move forward must now satisfy strict requirements. Developers must finance their own electrical infrastructure, demonstrate that their operations will reduce residential utility costs, comply with water regulations that prevent them from using supplies needed by local communities, maintain setback distances from residential areas, and provide detailed reports on electricity and water consumption. State agencies have been instructed to align their permitting decisions with these benchmarks using data from the audits.

Abbott has signaled his intention to pursue legislative action during the next regular session to eliminate state financial incentives currently available to data centers, further restricting the industry's expansion across Texas. The TCEQ is required to report to the governor's office by October 19, 2026, on its adherence to these directives.
